CHEROKEE COUNTY, Ga. (TCN) — A man who was recently convicted of murder for killing his stepchild’s father during parental visitation in 2021 has been sentenced to life in prison with the possibility of parole.
On Aug. 7, 2021, 37-year-old Nicholas Mimms killed 31-year-old Eduardo Gilberto Figueroa, the ex-fiancé of his wife. Figueroa had recently established parental rights and had arrived outside Mimms’ home with a stuffed animal to give the child. Mimms was reportedly waiting outside the home, clad in a bulletproof vest. He fatally shot Figueroa on the deck.
Twenty-five witnesses spoke at Mimms’ two-week trial in February, and Mimms was found guilty of felony murder, aggravated assault, and possession of a firearm during the commission of a felony.
According to CBS News, Mimms was sentenced on April 16 to life with the possibility of parole, plus an additional five years, and was ordered to have no contact with the family of the victim.
Of the sentence, CBS reports that Blue Ridge Assistant District Attorney Megan S. Hertel said, “These were two men with very different plans about how this day should go. Eduardo Figueroa arrived with love, excitement, and gifts for the son he was going to meet for the first time. The defendant brought a bulletproof vest and a loaded gun. This was a tragedy, and it should have never happened.”
According to Law & Crime, District Attorney Susan K. Treadaway said, “This sentence ensures the defendant is held accountable for taking a father from his child and forever altering the lives of those left behind.”
