The Harris County Sheriff’s Office said Sunday they had arrested Rivera’s mother, 51-year-old Alva Cornejo.
Deputies were called to the home before the shooting, KRIV reported. Rivera reportedly dropped the children off at their mother’s apartment at around 10 p.m. on Monday but was loud and confrontational. The sheriff’s office said that Rivera reportedly shoved her when she came outside with friends to get the children out of his truck.
Rivera reportedly grabbed a firearm and yelled at the children’s mother as the children were taken inside. He did not, at that time, point the weapon at anyone.
It’s not clear whether he left and came back before shooting the boy or remained on the scene and shot him.
According to KTRK, the gunfire went through the wall and into another apartment, where the bullet was stopped by a drum set.
A warrant for Rivera’s arrest charges him with capital murder.
